NAGPUR BENCH OF BOMBAY HIGH COURT DIRECTED STATE GOVERNMENT TO FILE ACTION TAKEN REPORT (ATR) ON THE RECOMMENDATIONS OF HIGH POWER COMMITTEE ON THE ISSUES OF PLIGHT AND HARDSHIP FACED BY TRIBALS IN YAVATMAL DISTRICT.

While hearing the urgent Civil Application in Public Interest Litigation (PIL) Writ Petition filed by Vidarbha Jan Andolan Samiti, President Shri Kishore Tiwari in the matter of large scale Malnutrition Deaths of Tribal Children in Yavatmal District, which rocked the entire State due to its intensity, Division Bench Justice R.M.S. Khandeparkar and Justice S.R. Dongaonkar, at Nagpur Bench of Bombay High Court today ordered that the State Government to file Action Taken Report (ATR) on the findings and recommendations in the Report submitted by the High Power Committee appointed by High-court by 25th August, 2006 and submit the affidavit to this effect, in connection with the measures under various schemes being implemented by the Government to fight out the cases of Malnutrition and other basic amenities pertaining to protection of Human Rights of the Tribal Families in the Tribal Belts of Yavatmal District.

Earlier, High Court heard the matter at length and also taken the report of the Committee headed by Divisional Commissioner, Amravati and Affidavits by the State Government on record filed pursuant to the earlier directions of the High Court in which it has been stated that Government has nominated Divisional Commissioner, Amravati, who shall be responsible for monitoring the subject matter of petition, and who shall be responsible to monitor even the progress of this petition, and shall have a direct rapport with the Government in this matter”.

This Public Interest Litigation was filed in the year 2003 by Shri Kishore Tiwari highlighting the miserable state of life of the tribals families in the Yavatmal District and the cases of large scale malnutrition and starvation deaths in the Kolam Tribals and brought in light a alarming case of violation of Fundamental Human Rights of the Tribals due to failure on the part of the administration to implement to various schemes of Government, including denial of Food, Shelter, Health, Education and Graceful Life to the Tribals residing in the Yavatmal District. The PIL highlighted the gross negligence on the part of administration and exposed the lapses in the functioning of various departments.

Considering the gravity and seriousness of the matter, Hon’ble Division Bench of the High Court from time to time had passed various Interim Orders in the matter and finally taken on record the report submitted by its Committee which was appointed in the year April, 2004. On the earlier occasions, the High –Court expressed its desire to pass Orders on next date of hearing so as to direct the authorities to take urgent and immediate steps for implementation of the recommendations in the Committee Report and make provision for basic infrastructure required in Tribal Belts of Yavatmal District. As directed by High Court, the present Divisional Commissioner of Amravati Dr. Sudhir Goyal undertook a tour so as to personally visit certain segments of Tribal Belt of Yavatmal and submitted his affidavit today which was taken on record and after hearing the matter at length, the High-Court passed significant order that the State Government to act on Committee Report immediately and submit the Action Taken Report (ATR) by 25th August, 2006.

The High Court adjourned the hearing to 28th August, 2006 for further orders.
